After more than 30 years in prison on charges of slaying a Louisiana guard, ex-Black Panther Herman Wallace is requesting a new trial, contending that prosecutors unlawfully withheld pertinent information that could have potentially swayed the verdict in his favor.
In 1972, Wallace was convicted of stabbing to death state penitentiary guard Brent Miller, after a fellow inmate testified against him in court.
According to Wallace’s attorney Nick Trentecosta, prosecutors failed to inform the defense that the prison warden assured the prosecution’s key witness that he would assist in getting him a pardon.
This help could be considered a bribe in exchange for the inmate’s testimony against Wallace—an arrangement defense claims they should have known about.
Hezekiah Brown—the inmate who testified against Wallace in court—was imprisoned on a rape conviction. He was released in the 1980s.
Wallace and his lawyer claim they can produce documents and a witness who can prove that the prison warden and Brown had a pardon agreement before Wallace’s trial was underway.
