DNA Exonerates Man After Two Decades in Prison

DNA evidence was used to exonerate a 39-year-old North Carolina man convicted of raping a young girl in 1987. The man served nearly 20 years in prison before being freed earlier this week.

In 1989, Dwayne Allen Dail was sentenced to more than two life terms in prison on charges of first-degree rape, among others. The conviction was based on victim identification and hair found at the scene thought to be consistent with Dail’s.

Case Raises Doubts

However, prosecutors even had their doubts about the case—which was tried prior to the advent of DNA testing—according to Wayne District Attorney Branny Vickory. The nonprofit organization N.C. Center for Actual Innocence took up Dail’s case and uncovered evidence that authorities believed had been destroyed.

The evidence proved Dail’s innocence.

“The science has proved that Mr. Dail is innocent. He didn’t do it,” said Vickory.

A state judge dropped the rape charges against Dail on Tuesday and he was immediately released from prison.
