DNA Testing Clears Convicted Rapist

A Florida man convicted of rape in 1982 will be freed from prison after DNA testing proves he wasn’t the perpetrator of the crime, according to prosecutors.

Orlando Bosquete, 51, was serving a 55-year sentence for breaking into the rape victim’s home and sexually assaulting her. The victim identified Bosquete and his accomplice who were arrested at a local convenience store that same night.

On Tuesday, prosecutors will ask a judge to release Bosquete from prison and dismiss his conviction since genetic testing that wasn’t available 20 years ago proved that Bosquete didn’t commit the crime.

So far, Bosquete has served almost 13 years of his 55-year sentence. He escaped from prison twice and spent 10 years out of jail in 1985 when he escaped shortly after his conviction. He was caught three months later, but escaped again only to return a year later.

According to Sheriff’s spokeswoman Becky Herrin, statute of limitations laws will prevent any other suspects from being pursued in the case.
