Jury Awards Couple $15.5 Million for False Arrest

A federal jury in Illinois awarded over $9 million in damages to a man who served eight months in a county jail for the sexual assault and murder of his young daughter. His wife was awarded $2.5 million in damages.

In June 2004, three-year-old Riley Fox was found half-naked about four miles from her family’s home in Wilmington. Her father, Kevin Fox, was arrested and jailed, but DNA evidence later secured his release.

Fox and his wife, Melissa, sued for false arrest, malicious prosecution, and other civil rights violations. After a seven-week trial, the jury ruled in favor of the Foxes and awarded them what is believed to be the largest verdict of its kind in Illinois.

“It was 10 people on the jury, and they found I did nothing wrong. I was in the right,” said Kevin Fox.
