Charges were recently dropped against members of a family who were on vacation in Florida and were arrested.
The family claims they were wrongly arrested and assaulted by a sheriff’s deputy at their waterfront home in Collier.
Arrest in the Middle of the Night
According to reports, Tracy Barry, 25, was arrested and pepper sprayed by sheriff’s deputy, Juan Muniz, as her two children watched.
The arrest was caused by a noise complaint claiming the Barry house was blaring music at 4:30 in the morning.
The incident reportedly became intense after Muniz asked Barry to show him proof of residence at the house and Barry refused to let him inside since the children were sleeping.
Muniz then reportedly grabbed Barry’s arm and she shoved him away.
Family Charged
Barry and her 53-year-old father, and daughter Sarah, 18, were all charged with battery of a law enforcement officer.
Barry was also charged with resisting an officer with violence.
Due to misconstrued accounts of the night, the family was charged, but later released and the charges were dropped when it was revealed the family had, in fact, not committed any crime.
“They were adamant this should not happen to anyone else,” explains John Hisler, of the family’s hiring of lawyers to prove their innocence.
