Hit-and-Run Case May Get Thrown Out of Court

The fate of a man involved in a hit and run case in Bristol, Connecticut hinges on whether or not police illegally seized his vehicle.

Edward Hayden, 36, of Terryville, CT is being held without possibility of parole for the moment on charges stemming from a November 25, 2005 accident where Hayden apparently struck and injured a Bristol man. Hayden’s Lawyer insists that the police acted on information they obtained illegally after seizing Hayden’s vehicle and then getting a search warrant to do so. Any information the police got after the illegal seizure is inadmissible because of the illegal means by which the police got it.

Hayden is being held because of a long history of failing to appear for his scheduled court dates. He is also being held on suicide watch because of comments he made before Judge John Cronan, who is hearing Hayden’s case.

Police responded to a call from Hayden’s girlfriend who told officials that Hayden planning on leaving the state.

How police seized Hayden’s vehicle remains unclear, but they found Hayden after a high-school football game at Muzzy Field when a truck that allegedly was owned by Hayden hit another man, Mark Dudzinski. Hayden was found to have a suspended driver’s license and had a history of driving and DMV legal problems.

Deputy Assistant Public Defender Damian Tucker, Hayden’s lawyer, has said that police only found proof of the accident after seizing Hayden’s truck, which they did illegally. If the police were found to have acted illegally, the entire case against Hayden could get thrown out, regardless of his guilt.

Meanwhile Hayden is being charged with charged with operating a motor vehicle while his license was under suspension, driving without insurance, improper use of a marker plate, interfering with police and second-degree making a false statement. Hayden was also charged with evading responsibility, a felony crime punishable by up to 10 years in prison.
