A lawsuit filed against a motorist for the death of an elderly woman has been settled, but whether the widower will ever get the money is in question.
The case was settled for $500,000; however, a determining factor about whether the settlement is due depends upon the victim’s insurance company.
Hit and Run?
Bill Lewis, 85, filed the suit against Lori Marston of Buxton, MA, due to her involvement in his wife’s fatal accident.
Ethel Lewis, 76, was getting her newspaper from a mailbox across the street from her home the morning that Marston’s minivan allegedly hit her.
However, Marston was never prosecuted by the York County District Attorney’s Office since Lewis’ insurance report and the police report doesn’t add up.
“They confessed that she was liable,” says an attorney for Lewis, Randall Smith.
Victim Uninsured
According to the police report, the incident was a hit and run.
Though it was revealed after the suit was filed that Lewis’s insurance company, GEICO, was trying to cancel her coverage since she was not making her payments.
The settlement money has reportedly not yet been distributed to either party since there are conflicting reports on both sides regarding what went on at the accident and the whether the victim was insured.
