Ohio Inmate’s Execution Blocked by Supreme Court

The execution of a convicted murderer has been halted by the U.S. Supreme Court to determine whether Ohio’s lethal injection procedure is considered cruel and unusual punishment.

The high court’s decision was in accordance with two lower courts that had previously delayed Kenneth Biros’ death and came over six hours after his scheduled execution time at the state’s death house.

While the Supreme Court debated, the execution team was waiting and ready to administer the fatal drugs if the approval was granted.

“To put these poor people [Biros and his family] through that is just not right,” said his defense attorney Timothy Sweeney.

Lethal Injection Too Painful?

Ohio’s method of lethal injection is not the only one that has been questioned. More and more state courts are blocking executions until further research proves the process does not cause an inmate any unnecessary pain and suffering.

The U.S. Constitution forbids any form of punishment that inflicts severe and undue pain, and the issue of cruel and unusual punishment through execution methods has become a forerunner in the criminal justice system nationwide.
