North Dakota “Shoot the Burglar” Law Advances

A proposed bill that would allow North Dakota residents to shoot a carjacker or burglar without fearing arrest or a civil suit is progressing, and the National Rifle Association continues to promote the law in other states.

“This bill is simply a citizen’s version of homeland security,” said state Representative Ron Carlisle.

What the Law Entails

The law would eradicate any language that claims retreating is better than using deadly force. Additionally, it would presume an individual is justified if he/she shoots a carjacker or burglar in his/her vehicle, workplace, or home.

The “shoot the burglar” law would protect shooters from getting arrested or charged unless police find probable cause to believe it was a legitimate crime.

Law enforcement officials and county prosecutors oppose the bill, contending that it would make it more difficult to disprove self-defense arguments.

The bill will go to the North Dakota Senate for a vote.
