Man Challenges Trooper’s Tactic

A Washington man who was issued a speeding ticket after being pulled over by a state trooper hiding in the median challenged the officer’s tactic and won.

“Age Old” Practice

Earlier this year, Carl Hu was ticketed for speeding on an interstate highway near Ritzville. Hu claimed that the trooper violated a state lighting law by not having his headlights on before the stop, which happened at night.

“Here you got a practice that just seems age old. As far as you can remember, the police have done it this way. Why hasn’t somebody picked up on this?” Hu asked.

He added: “And he left his lights off during the stop and when we pulled into traffic, there still weren’t any lights on and I was concerned about that.”

Judge Dismisses the Case

Both Hu and the trooper sent statements to Judge Adalia Hille, who ended up dismissing the case.

“I found the letter, opened it up, and I was as surprised as anybody that the judge agreed with me,” said Hu.

According to Judge Hille, the state did not meet its burden of proof. A higher court could overturn the judge’s ruling, but it was not clear whether the state would appeal it. Washington State Patrol did say it was exempt from the lighting law, and the attorney general’s office wrote an opinion siding with the trooper.
