Supreme Court Rules Against Execution for Child Rape

The U.S. Supreme Court recently denied a state law that has been the cause of much debate in recent years throughout the country.

The law struck down reportedly stated that criminals convicted of raping children were eligible for execution.

Execution of Rapists Violates Constitution

According to reports, a 5-4 vote by the court claimed the law implementing the death penalty in child rape cases violates the U.S. Constitution.

The U.S. Constitution is violated by this law since it has a ban on cruel and unusual punishment.

“The death penalty is not a proportional punishment for the rape of a child,” explains Justice Anthony Kennedy.

Kennedy’s four liberal colleagues reportedly agreed and supported his decision while four more conservative ones disagreed.

Execution in the U.S.

Documents show that there hasn’t been an execution in the U.S. for a crime in 44 years that didn’t involve the death of the victim.

Many lawmakers believe that since rape, although a heinous crime, doesn’t always involve a death there shouldn’t be a clear ruling across the board for all cases.
