Judge Rules Teen Unfit For Rape Trial

A teenage boy accused of sexually assaulting an eight-year-old girl and burying her in an abandoned landfill has been deemed mentally incompetent and unfit to stand trial on charges of attempted first degree murder, kidnapping, sexual battery, and other counts.

Eighteen-year-old Milagro Cunningham has been ordered by a Florida Judge to be admitted to a mental treatment facility of the Department of Children and Families. The judge’s ruling requires that Cunningham’s condition be monitored for six months.

The teen’s public defender contended last year that his client communicated and understood “within the range of a seven to nine-year old child.”

Furthermore, two of the three psychological experts that evaluated Cunningham agreed that the teenager was mentally incompetent.
