Lubbock Defense Attorneys Help Teens with Drinking Tickets
Tickets for underage drinking have skyrocketed by 500 percent in Lubbock over the past year, and now a group of local criminal defense attorneys are coming to the aide of students who’ve been ticketed.
All of the attorneys—nearly 20 altogether—are members of the Lubbock Criminal Defense Lawyers Association, and they are offering to defend students free of charge. According to some of them, enforcement of laws against underage drinking are on the rise, not underage drinking itself.
“I see it as an overzealous police department. I don’t think the atmosphere has changed that much from one year to the next, we’re seeing a 500 percent increase, I mean kids are not having that more parties, said Rusty Gunter, president of the LCDLA.
Fourth Amendment Violations?
Gunter added that police may be violating constitutional amendments.
“There are some glaring Fourth Amendment violations,” he said. “Secondly, the citations are being given without probable cause.”
One student was cited for underage drinking while trying to do a favor for a friend, Gunter said. The student was picking someone up from a party when he got busted. That’s when the citation was issued, he said.
“They are just citing everyone, and they’re not narrowing to a people who are allegedly committing the criminal offense. It’s just a shotgun approach,” said Gunter.
