Texas takes BWI laws seriously
Most people are familiar with the term DWI, or driving while intoxicated, but many people are not familiar with BWI, or boating while intoxicated.
More than 620,000 boats are registered to travel in Texas waters, and like a DWI, a BWI is a Class B misdemeanor requiring a minimum confinement term of 72 hours.
Texas has more square miles of inland water than any other state, and people operating on the waterways should be prepared to take the same precautions as driving on the highways to avoid a BWI.
The Texas Open Container Law makes it illegal to have an open container of alcohol in a car on a public roadway, which does not apply to boats. It is not illegal to have an open container of alcohol on a boat in Texas, however, if operating the boat the drive must be aware that police can administer many of the same tests in attempting to detect if a DWI violation has occurred, including field sobriety and blood alcohol level tests.
