Mr. Varga is committed to the art and craft of jury trials. When in trial, he is at peak performance. He generally knows his facts much better than the prosecutor. While a typical prosecutor may try over a dozen cases a year, Mr. Varga tries about one or two cases a year, and puts that much more effort into each case. As a result of that effort, the best cases do not even go to trial because they are dismissed. Many more are reduced to minor charges.
However, the vast majority of criminal cases result in plea bargains that are not reduced to minor charges. This is true no matter who defends the accused. You can search the entire World Wide Web without finding another criminal lawyer who will tell you this. But it is the truth, no matter whom you hire. So, in this vast majority of cases, what difference can your lawyer make?
First, some of these cases can be worked toward a better plea bargain by good investigation, or by filing appropriate motions. For instance, in a Los Angeles County case involving possession of drugs for sale, Mr. Varga filed a five-part suppression motion. But before it could be heard, the prosecutor lowered the offer to one without jail time, which his client accepted.
However, sometimes a fast plea bargain is best for the client. For instance, sometimes the prosecutor forgets to add allegations or to consider facts that would result in more jail time. Those situations call for quick and decisive action that will be in the client’s best interest. It may be wisest to take the offer before the tables turn. The key, however, is full client participation in the decision to accept a plea bargain.
With Mr. Varga, you will never accept or reject a plea bargain without a thorough understanding of your options and the consequences of your decision. You will understand—not just hear—your rights, the charges against you, and the consequences of your decision.
When you were first read your rights, you were probably nervous, had questions, and were distracted by millions of racing thoughts and concerns. Your criminal defense lawyer needs to know when, where, and how to strike when it is required to obtain the best result for you. Many lawyers imitate that sort of effectiveness by acting “aggressive” with you. That is not what you need. Your lawyer should be personable, truthful, caring, and protective of you.
