DUI and Alabama Law
There are very strict and non-negotiable consequences for being convicted of a DUI offense in Alabama. They fall into two categories: criminal punishment and criminal punishment.
Criminal Case Punishment If You're Convicted
1st DUI conviction: Maximum sentence of one year in jail. Fine between $600 and $2,100.
2nd conviction: Five days in jail is mandatory, with a maximum of one year. Fine between $1,100 and $5,100.
3rd conviction: Sixty days in jail is mandatory, with a maximum sentence of one year. Fine between $2,100 and $10,100.
4th or subsequent DUI conviction (a Class C Felony): Minimum sentence of one year and one day in jail with a mandatory minimum of at least 10 days in jail. Maximum sentence is 10 years in jail. Fine between $4,100 and $10,100.
Civil Case Punishments If You're Convicted
1st DUI conviction: 90 day license suspension
Refusal to take breathalyzer test: Automatic 90 day license suspension.
2nd conviction: Revocation of driving privileges for a year.
3rd conviction: Revocation of driving privileges for three years.
4th or subsequent DUI conviction: Revocation of driving privileges for five years.
The mandatory sentences described above are not negotiable upon conviction. These mandatory sentences are set by law — they do not depend on the specific details of your case.
